NEW HOME MOVING
TERMS OF SERVICE AND WEBSITE USE

These Terms of Service and Website Use ("Terms") govern your access to and use of the New Home Moving website, booking system, communications, estimates, and moving or related services arranged through New Home Moving.
Please read these Terms carefully before booking or using any service.
BY REQUESTING AN ESTIMATE, SUBMITTING A BOOKING, PROVIDING PAYMENT INFORMATION, CLICKING "BOOK," "BOOK NOW," "I AGREE," OR A SIMILAR BUTTON, ACCEPTING A BOOKING CONFIRMATION, OR OTHERWISE USING SERVICES ARRANGED THROUGH NEW HOME MOVING, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS.
If another person makes a booking on your behalf, you authorize that person to act on your behalf in connection with the booking and agree that their acceptance of these Terms may bind you.
If you do not agree with these Terms, do not book or use the services.
1. DEFINITIONS
For purposes of these Terms:
"New Home Moving," "NHM," "we," "us," or "our" means New Home Moving and, where applicable, its owners, affiliates, representatives, agents, contractors, and service providers.
"Customer," "you," or "your" means the individual or organization requesting, booking, paying for, receiving, or otherwise benefiting from services.
"Service Provider" means any mover, driver, helper, owner-operator, subcontractor, independent contractor, carrier, crew, or other person or business performing or assisting with services arranged through New Home Moving.
"Services" means moving, transportation, loading, unloading, packing, unpacking, furniture delivery, furniture assembly or disassembly, junk removal, storage coordination, long-distance transportation, labour-only services, and any other related service arranged through New Home Moving.
"Booking Confirmation" means the estimate, quote, confirmation, work order, invoice, email, text message, online booking summary, or other documentation describing a particular service.
These Terms and the applicable Booking Confirmation together form the agreement governing your service.
2. NATURE OF THE SERVICES
New Home Moving provides moving coordination, booking, scheduling, customer service, payment processing, logistics, and related services.
Physical moving and transportation services may be performed by independent contractors, owner-operators, subcontractors, third-party carriers, or other Service Providers arranged through New Home Moving.
Not every person performing physical work is necessarily an employee of New Home Moving.
New Home Moving may select, assign, replace, or subcontract Service Providers at its discretion based on scheduling, location, availability, equipment, job requirements, safety considerations, and other operational factors.
You are not guaranteed any particular mover, crew member, vehicle, owner-operator, or Service Provider unless expressly confirmed in writing.
A Service Provider does not have authority to modify these Terms, waive charges, make warranties on behalf of New Home Moving, settle claims, or otherwise bind New Home Moving unless New Home Moving expressly confirms the modification in writing.
3. ELIGIBILITY
You must be at least 18 years of age and legally capable of entering into a contract to book Services.
If you are booking on behalf of a company, family member, property owner, tenant, estate, organization, or another person, you represent that you have authority to make the booking and authorize the Services.
4. BOOKING CONFIRMATION AND CONTRACT DOCUMENTS
A booking is not guaranteed until New Home Moving accepts it.
Acceptance may occur through:
- written booking confirmation;
- email;
- text message;
- online confirmation;
- payment or deposit processing;
- verbal confirmation followed by performance of the Services; or
- another method reasonably indicating that the booking has been accepted.
Your Booking Confirmation may contain information including:
- service date;
- arrival window;
- pickup location;
- delivery location;
- crew size;
- hourly rate;
- minimum service period;
- travel charge;
- vehicle or truck fee;
- deposit;
- additional charges;
- estimated duration;
- estimated total;
- payment terms; and
- special instructions.
The Booking Confirmation is incorporated into these Terms.
If there is a conflict between these Terms and a specific written Booking Confirmation, the Booking Confirmation controls only with respect to the specific pricing, schedule, service details, or special conditions expressly stated in it.
5. ESTIMATES ARE NOT GUARANTEED FINAL PRICES
Unless expressly identified in writing as a guaranteed flat-rate price, all estimates are estimates only.
Moving time and final cost can be affected by circumstances that cannot always be accurately determined before the move.
Factors affecting the final cost may include:
- quantity of belongings;
- inaccurate or incomplete inventory;
- additional items;
- packing condition;
- stairs;
- elevators;
- elevator delays;
- loading dock restrictions;
- long carries;
- parking distance;
- difficult access;
- building restrictions;
- narrow hallways;
- oversized furniture;
- disassembly or assembly;
- additional stops;
- traffic;
- weather;
- road conditions;
- customer delays;
- key or access delays;
- additional packing;
- specialty items;
- changes to pickup or delivery location;
- additional labour;
- additional vehicles;
- waiting time;
- storage requirements;
- ferry delays;
- border or highway delays;
- unforeseen conditions; and
- Services requested after work begins.
You are responsible for the actual Services provided and charges incurred, regardless of any earlier estimate, unless New Home Moving expressly agreed to a guaranteed fixed price in writing.
6. HOURLY SERVICES AND BILLABLE TIME
Where Services are billed hourly, time will be calculated according to the pricing structure shown in the Booking Confirmation.
Depending on the booking, billable charges may include:
- moving labour;
- travel time;
- minimum booking time;
- vehicle or truck fee;
- fuel or transportation charges;
- packing time;
- loading;
- unloading;
- disassembly;
- assembly;
- additional stops;
- waiting time;
- additional crew members;
- specialty equipment;
- materials;
- parking;
- ferry charges;
- tolls;
- storage;
- disposal fees; and
- other charges applicable to the particular job.
The customer remains responsible for applicable minimum charges even if the move takes less time than the minimum booking period.
If the Customer delays the crew after arrival, billable time may continue during the delay.
7. CHANGES TO THE MOVE
You must notify New Home Moving as soon as possible of any material change to the move.
Material changes include:
- additional furniture;
- substantially more boxes;
- additional rooms;
- additional stops;
- change of address;
- stairs not previously disclosed;
- elevator restrictions;
- unusually long carries;
- parking restrictions;
- oversized items;
- heavy items;
- pianos;
- safes;
- exercise equipment;
- appliances;
- machinery;
- valuable or fragile items;
- storage requirements;
- packing requirements; and
- any condition materially affecting the work.
New Home Moving may modify the crew, equipment, vehicle, pricing, arrival window, estimated duration, or service plan when the information provided at booking materially differs from actual conditions.
If the changed circumstances make the job unsafe, impractical, unlawful, or materially different from what was booked, New Home Moving or the Service Provider may refuse or discontinue all or part of the Services.
8. CUSTOMER RESPONSIBILITIES
The Customer is responsible for:
- providing accurate and complete information;
- providing correct pickup and delivery addresses;
- providing an accurate description of the move;
- identifying unusual, heavy, fragile, high-value, or oversized items;
- advising us of stairs, elevators, loading docks, long carries, parking restrictions, or difficult access;
- obtaining elevator bookings where required;
- obtaining building or strata approvals where required;
- arranging legal and reasonably accessible parking;
- ensuring the premises are accessible at the scheduled time;
- ensuring items are packed and ready unless packing Services were booked;
- securing pets;
- keeping children and unauthorized persons away from active work areas;
- maintaining reasonably safe walkways and work areas;
- identifying fragile items;
- protecting valuables that should not be transported;
- inspecting property and belongings;
- maintaining appropriate insurance where desired;
- paying all amounts owing; and
- complying with these Terms.
The Customer is responsible for costs and delays arising from inaccurate or incomplete information.
9. PARKING, BUILDING ACCESS AND ELEVATORS
The Customer is responsible for arranging suitable parking and building access.
New Home Moving and Service Providers are not required to park illegally or in a location they reasonably consider unsafe.
The Customer is responsible for:
- parking permits;
- loading zone reservations;
- elevator reservations;
- loading dock reservations;
- building access fees;
- strata requirements;
- parking fees; and
- other location-specific requirements.
If suitable parking is unavailable, additional walking distance and resulting time may be billable.
New Home Moving is not responsible for delays caused by building management, security, concierge staff, elevators, loading docks, parking availability, access restrictions, or other conditions outside its reasonable control.
10. PACKING
Unless packing Services have been booked, the Customer is responsible for properly packing belongings.
Boxes should be:
- securely closed;
- reasonably sized;
- structurally sound;
- properly packed;
- capable of being safely lifted; and
- labelled where appropriate.
New Home Moving and its Service Providers are not responsible for loss or damage caused by inadequate packing, improper packing, overpacked containers, weak boxes, open containers, or insufficient protection.
Where the Customer packed a box or container, liability for damage to its contents may be denied where there is no reasonable evidence that external physical damage caused the loss.
11. FURNITURE DISASSEMBLY AND ASSEMBLY
Where requested, movers may assist with basic furniture disassembly and assembly.
The Customer acknowledges that some furniture is not designed for repeated disassembly, transportation, or reassembly.
This may include:
- particle-board furniture;
- flat-pack furniture;
- ready-to-assemble furniture;
- older furniture;
- furniture with stripped hardware;
- furniture previously repaired;
- pressboard furniture;
- glued furniture; and
- structurally weakened items.
To the fullest extent permitted by law, New Home Moving and its Service Providers are not responsible for failure, weakening, breakage, alignment problems, or damage resulting from the inherent condition or construction of such items.
Movers may refuse to disassemble or assemble an item if they reasonably believe doing so may cause damage or create a safety concern.
12. APPLIANCES AND ELECTRONICS
The Customer is responsible for properly preparing appliances and electronics for transportation.
Unless expressly agreed otherwise, movers are not responsible for disconnecting or reconnecting:
- natural gas appliances;
- hard-wired electrical equipment;
- plumbing;
- water lines;
- gas lines;
- permanently installed equipment; or
- equipment requiring a licensed trade.
New Home Moving does not guarantee the internal mechanical or electronic operation of appliances or electronics after transportation where there is no evidence of external physical damage caused during the move.
The Customer should back up computers and electronic data before transportation.
13. PROHIBITED AND RESTRICTED ITEMS
Unless expressly approved in writing, Services do not include transportation of:
- explosives;
- propane;
- gasoline;
- fuel;
- flammable liquids;
- corrosive substances;
- toxic materials;
- hazardous chemicals;
- illegal drugs;
- illegal goods;
- contraband;
- ammunition;
- firearms;
- dangerous weapons;
- pressurized hazardous containers;
- live animals;
- human remains;
- perishable goods requiring controlled refrigeration;
- items prohibited by law;
- property the Customer is not legally entitled to possess or transport; or
- any item that presents an unreasonable safety risk.
The Customer must not conceal hazardous, illegal, dangerous, or prohibited materials inside boxes, containers, furniture, vehicles, or other property.
The Customer is responsible for all loss, expense, cleanup cost, penalty, damage, injury, or liability caused by prohibited or undisclosed dangerous items.
14. HIGH-VALUE AND IRREPLACEABLE PROPERTY
The Customer should personally transport:
- currency;
- cash;
- jewelry;
- precious metals;
- securities;
- passports;
- immigration documents;
- legal documents;
- important records;
- medication;
- keys;
- collectibles;
- family heirlooms;
- irreplaceable photographs;
- high-value artwork;
- small high-value electronics; and
- other property of extraordinary or sentimental value.
If the Customer asks a Service Provider to transport unusually valuable property, the Customer must disclose the item and its approximate value before the move.
New Home Moving may refuse to transport such property or require additional written terms.
Failure to disclose extraordinary-value property may affect or eliminate any claim relating to the item.
15. RIGHT TO REFUSE OR STOP SERVICE
New Home Moving and its Service Providers may refuse, suspend, or stop Services where they reasonably determine that conditions are unsafe, unlawful, abusive, materially different from what was represented, or otherwise unsuitable for continued work.
Examples include:
- dangerous premises;
- unsafe stairs;
- structural hazards;
- active construction hazards;
- insect or pest infestations;
- biohazards;
- needles;
- bodily fluids;
- severe unsanitary conditions;
- illegal activity;
- threatening behaviour;
- harassment;
- intoxicated or aggressive persons;
- dangerous animals;
- extreme weather;
- unsafe road conditions;
- prohibited items;
- overloaded vehicles;
- unsafe lifting conditions;
- undisclosed exceptionally heavy items; or
- instructions that would likely cause injury or property damage.
If Services are stopped because of Customer conduct, inaccurate information, unsafe conditions, or circumstances within the Customer's responsibility, applicable minimum charges and Services already provided remain payable.
16. CUSTOMER PARTICIPATION
If the Customer, family members, friends, tenants, building staff, or other persons participate in loading, carrying, packing, moving, disassembly, assembly, or other work, they do so at their own risk.
New Home Moving does not supervise or assume responsibility for work performed by persons who are not authorized Service Providers.
New Home Moving and its Service Providers are not responsible for loss, damage, or injury caused or contributed to by unauthorized third-party participation.
17. ARRIVAL TIMES AND DELAYS
Arrival times are estimates unless expressly guaranteed in writing.
Moving schedules can be affected by:
- earlier jobs;
- traffic;
- weather;
- road conditions;
- mechanical issues;
- ferry schedules;
- accidents;
- customer delays;
- emergencies;
- staffing changes; and
- other circumstances outside reasonable control.
New Home Moving will make reasonable efforts to communicate material delays.
A delay does not automatically entitle the Customer to a discount, refund, cancellation, or compensation.
To the fullest extent permitted by law, New Home Moving is not responsible for consequential costs caused by delays, including:
- hotel expenses;
- rent;
- lost wages;
- lost income;
- missed appointments;
- penalties;
- business interruption;
- lost reservations; or
- other indirect losses.
18. LONG-DISTANCE MOVES
Long-distance transportation may involve:
- extended delivery windows;
- multiple drivers;
- multiple vehicles;
- route changes;
- consolidated shipments;
- temporary storage;
- transfer between vehicles;
- subcontracted carriers;
- ferry transportation; and
- delays outside New Home Moving's control.
Pickup and delivery dates or times provided for long-distance moves are estimates unless expressly guaranteed in writing.
Customers must provide accurate telephone numbers and remain reasonably available for communication regarding pickup and delivery.
Additional charges may arise from:
- unavailable delivery access;
- missed delivery;
- storage;
- waiting time;
- redelivery;
- shuttle vehicles;
- ferry costs;
- additional distance;
- changed destination; or
- circumstances not disclosed when the estimate was prepared.
19. JUNK REMOVAL AND DISPOSAL
Where junk removal or disposal Services are provided, the Customer represents that they own the property or otherwise have lawful authority to dispose of it.
Once property is removed for disposal, donation, recycling, or transfer, recovery may not be possible.
The Customer is responsible for clearly identifying property that is not to be removed.
New Home Moving is not responsible for property removed after the Customer identified it as junk, garbage, donation, recycling, or disposal property.
20. PAYMENT
Payment is due according to the terms of the applicable Booking Confirmation.
Unless otherwise agreed, payment may be required immediately upon completion of the Services.
New Home Moving may require:
- a deposit;
- credit card authorization;
- preauthorization;
- partial payment;
- advance payment; or
- full payment before Services begin.
All amounts are stated in Canadian dollars unless otherwise specified.
Applicable taxes will be added as required.
22. DIRECT PAYMENTS TO SERVICE PROVIDERS
Unless New Home Moving expressly authorizes otherwise, payment must be made through New Home Moving's approved payment process.
Customers should not make side payments, separate arrangements, or direct cash agreements with Service Providers relating to a New Home Moving booking without authorization.
New Home Moving is not responsible for private transactions entered into directly between a Customer and a Service Provider outside the New Home Moving booking.
23. UNPAID BALANCES
Amounts not paid when due remain payable.
Where legally permitted, New Home Moving may:
- reattempt payment;
- issue invoices;
- suspend future Services;
- cancel future bookings;
- refer unpaid balances for collection;
- commence legal proceedings; and
- recover reasonable collection costs associated with unpaid amounts.
The Customer remains responsible for Services properly provided even if the Customer later disputes a payment through a bank, card issuer, or payment processor.
24. CHARGEBACKS AND PAYMENT DISPUTES
A chargeback does not automatically extinguish the Customer's obligation to pay amounts legitimately owing.
Customers are encouraged to contact New Home Moving promptly regarding billing concerns so the matter can be reviewed.
Where a chargeback is initiated, New Home Moving may provide relevant information to the payment processor, financial institution, card network, collection agency, insurer, legal representative, or other party involved in resolving the dispute.
Where legally permitted, New Home Moving may recover reasonable fees or costs arising from an improper or unsuccessful chargeback.
25. DEPOSITS
New Home Moving may require a deposit to reserve a service date, crew, vehicle, or other resources.
Deposit requirements will be communicated in connection with the booking.
Unless otherwise stated in writing, deposits will be applied toward the final invoice.
The refundable or non-refundable status of a deposit is governed by the cancellation policy applicable to the booking.
26. CUSTOMER CANCELLATIONS
Unless a different cancellation policy appears in the Booking Confirmation:
More than 48 hours before the scheduled service
The Customer may cancel and receive a refund of the deposit, less any disclosed administrative or non-refundable booking charge.
Between 24 and 48 hours before the scheduled service
New Home Moving may retain up to 50% of the deposit.
Less than 24 hours before the scheduled service
The deposit may be non-refundable.
After a crew or vehicle has been dispatched
The Customer may be responsible for the applicable minimum service charge, travel charges, dispatch expenses, and other costs already incurred.
A cancellation is effective only when communicated directly to New Home Moving through an accepted communication method.
Leaving a voicemail, sending an unread message, contacting an individual mover, or attempting contact without receiving confirmation may not constitute confirmed cancellation.
27. RESCHEDULING
Rescheduling is subject to availability.
Requests made more than 48 hours in advance will generally be accommodated where scheduling permits.
Late rescheduling may be treated as a cancellation and new booking.
Pricing, crew availability, vehicle availability, and other terms may change when a booking is rescheduled.
28. CANCELLATION OR RESCHEDULING BY NEW HOME MOVING
New Home Moving may cancel, reschedule, delay, substitute equipment, or assign a different Service Provider due to circumstances including:
- illness;
- staffing shortages;
- vehicle breakdown;
- weather;
- unsafe conditions;
- emergencies;
- road closures;
- regulatory restrictions;
- operational issues;
- inaccurate Customer information; or
- circumstances outside reasonable control.
If New Home Moving cancels a booking and no reasonable substitute can be provided, amounts paid specifically for Services not performed will generally be refunded.
Except where required by law, New Home Moving is not responsible for indirect, incidental, special, or consequential losses arising from cancellation or rescheduling.
29. CONDITION OF PROPERTY
Customers should inspect furniture, belongings, floors, walls, doors, hallways, elevators, and other relevant property before moving begins.
Service Providers may photograph or otherwise document existing conditions.
Pre-existing:
- scratches;
- dents;
- cracks;
- chips;
- stains;
- structural weakness;
- loose components;
- broken hardware;
- water damage;
- wear; and
- other existing conditions
remain the Customer's responsibility.
New Home Moving is not responsible for pre-existing damage.
30. DAMAGE CLAIM PROCEDURE
If the Customer believes loss or damage occurred during the Services, the Customer should notify New Home Moving as soon as reasonably possible.
The Customer should:
- photograph the alleged damage;
- preserve the item;
- preserve relevant packaging;
- provide a description of what occurred;
- provide evidence of ownership if requested;
- provide information about age, condition, purchase price, and replacement value if requested;
- cooperate with an investigation; and
- allow reasonable inspection before repairing, disposing of, or replacing the item.
Where reasonably possible, visible damage should be reported before the crew leaves the premises.
A written claim should be submitted within 7 days of completion of the move.
Claims submitted later may be denied where the delay materially interferes with investigation, inspection, evidence preservation, or determination of responsibility.
Submission of a claim does not constitute an admission of liability.
New Home Moving may refer a claim to the applicable Service Provider, owner-operator, carrier, insurer, claims administrator, repair provider, or other responsible party.
31. NO GUARANTEE OF THIRD-PARTY INSURANCE
New Home Moving does not represent, warrant, or guarantee that insurance maintained by any Service Provider, owner-operator, carrier, vehicle owner, subcontractor, or other third party provides coverage directly to the Customer or will reimburse the Customer for a particular loss.
The existence of any insurance policy does not increase the liability assumed under these Terms.
Customers who require additional protection should independently determine whether suitable coverage is available through:
- homeowner insurance;
- renter insurance;
- commercial insurance;
- moving insurance;
- transportation insurance; or
- another insurance product.
32. VALUATION AND LIMITATION FOR CUSTOMER PROPERTY
Except where a different valuation is expressly agreed to in writing, liability for physical loss of or damage to household goods may be limited to $0.60 per pound per item, to the fullest extent permitted by applicable law.
This is a contractual valuation and limitation of liability.
It is not replacement-value insurance and does not represent an agreement to reimburse the Customer for the retail or replacement value of an item.
Where the item's weight cannot reasonably be established, New Home Moving may use a reasonable estimated weight based on manufacturer information, comparable items, industry references, or other reasonable evidence.
Customers requiring greater protection must arrange appropriate insurance or obtain written confirmation of a different valuation before the Services begin.
33. EXCLUSIONS FROM PROPERTY LIABILITY
To the fullest extent permitted by law, New Home Moving and its Service Providers are not responsible for loss or damage resulting from:
- improper packing;
- Customer-packed boxes;
- inadequate containers;
- overpacked boxes;
- fragile items not disclosed;
- concealed damage;
- pre-existing damage;
- deterioration;
- ordinary wear;
- inherent vice;
- defective construction;
- structural weakness;
- loose components;
- unstable furniture;
- particle-board or pressboard furniture;
- items that cannot safely withstand normal moving;
- internal mechanical failure;
- internal electronic failure;
- data loss;
- temperature sensitivity;
- humidity;
- natural expansion or contraction;
- liquids left inside items;
- plants;
- perishables;
- prohibited items;
- hazardous items;
- extraordinary-value items not disclosed;
- items transported contrary to mover advice;
- damage caused by Customer instructions;
- damage caused by Customer helpers or third parties;
- inaccessible or unsafe premises;
- inadequate clearance;
- weather;
- road conditions;
- unavoidable vibration;
- events beyond reasonable control; or
- risks inherent in the nature of the item being transported.
34. TIGHT ACCESS AND CUSTOMER-DIRECTED MOVEMENT
Where an item cannot reasonably pass through a doorway, hallway, stairway, elevator, or other access point without an increased risk of damage, a mover may refuse to move it.
If the Customer nevertheless requests that the mover attempt the movement after the risk has been identified, the Customer accepts the increased risk associated with that instruction.
This may include risk to:
- furniture;
- walls;
- doors;
- floors;
- ceilings;
- railings;
- elevators;
- fixtures; and
- surrounding property.
Where legally permitted, New Home Moving will not be responsible for damage arising directly from such Customer-directed activity.
35. CLAIM RESOLUTION
New Home Moving may, at its discretion and without admitting liability:
- deny a claim;
- request further evidence;
- arrange inspection;
- obtain repair estimates;
- repair an item;
- contribute toward repair;
- replace an item;
- provide a settlement;
- refer the matter to another responsible party; or
- offer another reasonable resolution.
If a settlement is offered, New Home Moving may require a written release before payment.
Replacement, repair, or settlement does not necessarily entitle the Customer to retain both the damaged property and its full replacement value.
Depreciation, age, condition, market value, repairability, salvage value, contractual valuation, and applicable liability limits may be considered.
36. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, NEW HOME MOVING SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES.
THIS INCLUDES, WITHOUT LIMITATION:
- LOST PROFITS;
- LOST INCOME;
- LOST BUSINESS;
- LOST OPPORTUNITIES;
- BUSINESS INTERRUPTION;
- LOSS OF USE;
- RENTAL EXPENSES;
- HOTEL EXPENSES;
- MISSED APPOINTMENTS;
- LOSS OF DATA;
- EMOTIONAL OR SENTIMENTAL VALUE;
- CONSEQUENTIAL PROPERTY LOSS; AND
- OTHER INDIRECT FINANCIAL LOSS.
Except for physical loss of or damage to Customer property governed by the valuation provisions above, and except where a limitation is prohibited by applicable law, New Home Moving's aggregate liability arising from a particular booking shall not exceed the lesser of:
(a) the amount actually paid to New Home Moving for the specific Services giving rise to the claim; or
(b) CAD $1,000.
Nothing in these Terms limits liability to the extent such liability cannot lawfully be excluded or limited.
37. ASSUMPTION OF ORDINARY MOVING RISKS
Moving inherently involves physical handling, lifting, carrying, loading, transportation, vibration, shifting, stacking, disassembly, reassembly, and movement through confined spaces.
Minor wear may occur despite reasonable care.
The Customer acknowledges ordinary risks associated with moving, including minor:
- scuffs;
- rub marks;
- surface marks;
- compression;
- shifting;
- wear; and
- similar effects associated with normal handling.
Not every cosmetic change constitutes compensable damage.
38. FORCE MAJEURE
New Home Moving is not responsible for delay or failure caused by circumstances beyond reasonable control, including:
- severe weather;
- flooding;
- wildfire;
- earthquake;
- snow or ice;
- road closures;
- traffic accidents;
- government restrictions;
- labour disruption;
- utility failure;
- telecommunications outage;
- vehicle failure;
- ferry cancellation;
- emergency conditions;
- civil disturbance;
- public-health emergency; or
- other events outside reasonable control.
Affected obligations may be delayed or modified for the duration of the event.
39. CUSTOMER CONDUCT
Customers must treat Service Providers and New Home Moving personnel respectfully.
New Home Moving may immediately suspend or terminate Services where a Customer or person associated with the Customer engages in:
- threats;
- harassment;
- violence;
- discrimination;
- abusive conduct;
- deliberate obstruction;
- illegal activity;
- sexual harassment;
- intimidation; or
- conduct reasonably creating a safety concern.
Where Services are terminated for Customer misconduct, charges already incurred and applicable minimum charges remain payable.
40. INDEMNIFICATION
To the fullest extent permitted by law, the Customer agrees to indemnify and hold harmless New Home Moving and its owners, affiliates, representatives, agents, contractors, and Service Providers against claims, liabilities, losses, damages, costs, and reasonable legal expenses arising from or relating to:
- the Customer's breach of these Terms;
- false, inaccurate, or incomplete information supplied by the Customer;
- illegal or prohibited property;
- hazardous materials;
- Customer-directed unsafe activity;
- Customer helpers or third parties;
- lack of authority to move or dispose of property;
- violation of building, strata, parking, or property rules;
- damage caused by conditions under the Customer's control;
- injury caused by animals associated with the Customer;
- unlawful instructions; or
- violation of another person's rights.
This provision does not require the Customer to indemnify New Home Moving for liability that cannot lawfully be transferred to the Customer.
41. PHOTOGRAPHS AND SERVICE DOCUMENTATION
New Home Moving and its Service Providers may photograph or record property where reasonably necessary for:
- documenting pre-existing condition;
- inventory verification;
- proof of service;
- damage documentation;
- claim investigation;
- training;
- safety;
- quality control; or
- dispute resolution.
Such documentation may include photographs of belongings, rooms, access points, loading conditions, vehicles, and completed work.
New Home Moving will handle personal information in accordance with applicable privacy requirements and its Privacy Policy.
42. MARKETING PHOTOS AND VIDEOS
New Home Moving may request permission to use photographs, videos, reviews, testimonials, or other content for marketing.
Where separate marketing consent is requested, such consent may authorize New Home Moving to use approved content for:
- website content;
- social media;
- advertising;
- promotional materials;
- portfolios; and
- other business marketing.
Declining optional marketing consent will not prevent the Customer from receiving ordinary moving Services.
43. REVIEWS AND TESTIMONIALS
If you voluntarily submit a review, testimonial, photograph, comment, or similar content to New Home Moving for publication, you grant New Home Moving a non-exclusive, worldwide, royalty-free licence to reproduce, display, publish, format, and distribute that content for legitimate business and promotional purposes.
You represent that content you submit does not infringe another person's rights.
44. PRIVACY
New Home Moving may collect information reasonably necessary to:
- provide estimates;
- process bookings;
- communicate with Customers;
- coordinate Service Providers;
- process payments;
- investigate claims;
- maintain business records;
- improve Services;
- prevent fraud;
- comply with legal obligations; and
- operate the business.
Information may be shared with Service Providers and other parties where reasonably necessary to perform the requested Services or operate the business.

45. ELECTRONIC COMMUNICATIONS
By communicating with New Home Moving electronically, you consent to receiving service-related communications through methods including:
- email;
- SMS;
- telephone;
- online forms; and
- website notices.
Electronic communications may be used for:
- estimates;
- booking confirmations;
- scheduling;
- arrival notices;
- payment information;
- invoices;
- receipts;
- claims;
- service updates; and
- related transactional purposes.
46. WEBSITE USE
The New Home Moving website and booking system are provided for legitimate informational and booking purposes.
You may not:
- interfere with the website;
- attempt unauthorized access;
- introduce malicious software;
- scrape the website through unauthorized automated systems;
- impersonate another person;
- submit fraudulent bookings;
- use stolen payment information;
- abuse the booking system;
- attempt to bypass security features;
- copy protected website content for commercial use; or
- use the website for unlawful purposes.
New Home Moving may restrict access where misuse is suspected.
47. INTELLECTUAL PROPERTY
Unless otherwise stated, the New Home Moving website and its original:
- text;
- branding;
- logos;
- graphics;
- photographs;
- layouts;
- designs;
- software;
- written content; and
- other materials
are owned by or licensed to New Home Moving.
Customers are granted a limited right to access the website for personal or legitimate business use in connection with requesting or receiving Services.
No other licence is granted.
48. THIRD-PARTY SERVICES
New Home Moving may use third parties in connection with:
- payment processing;
- communications;
- booking software;
- maps;
- analytics;
- advertising;
- transportation;
- storage;
- disposal;
- insurance administration;
- website hosting; and
- other business operations.
New Home Moving is not responsible for the independent websites, policies, systems, or services of third parties except to the extent required by applicable law.
49. NO GUARANTEE OF CONTINUOUS WEBSITE AVAILABILITY
New Home Moving does not guarantee that the website, booking system, or electronic communications will always be uninterrupted, error-free, secure, or available.
Temporary outages do not invalidate an otherwise confirmed booking.
Customers should contact New Home Moving if they are uncertain whether a booking, cancellation, payment, or message was received.
50. NO WAIVER
Failure by New Home Moving to enforce a provision of these Terms on one occasion does not waive the right to enforce that provision later.
A waiver is effective only if expressly made by New Home Moving.
51. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be severed or modified to the minimum extent necessary while preserving its intended effect as closely as legally permissible.
The remaining provisions will continue in effect.
52. ENTIRE AGREEMENT
These Terms, together with the applicable Booking Confirmation and any additional written terms expressly incorporated into the booking, constitute the agreement between the Customer and New Home Moving regarding the Services.
They supersede prior discussions, representations, estimates, communications, or understandings concerning the same Services except where expressly incorporated into the final Booking Confirmation.
53. CHANGES TO THESE TERMS
New Home Moving may update these Terms from time to time.
Changes posted to the website apply to website use from the effective date shown and generally apply to bookings made after the updated Terms take effect.
Unless otherwise permitted by law, the Terms applicable to a particular confirmed booking are the Terms accepted in connection with that booking.
54. ASSIGNMENT AND SUBCONTRACTING
The Customer may not transfer or assign a booking or rights under these Terms without New Home Moving's consent.
New Home Moving may subcontract, assign, or delegate performance of Services or administrative functions where reasonably necessary for business operations.
55. INDEPENDENT SERVICE PROVIDERS
Where Services are performed by an independent Service Provider, that Service Provider remains responsible for its own business operations, personnel, taxes, licences, expenses, vehicles, equipment, regulatory obligations, and other responsibilities applicable to its business.
Nothing in these Terms gives an individual Service Provider authority to enter into contracts on behalf of New Home Moving except to the extent expressly authorized.
56. NO THIRD-PARTY BENEFICIARIES
Except where these Terms expressly provide protections to New Home Moving's affiliates, Service Providers, representatives, contractors, owners, agents, or other specified persons, no third party acquires contractual rights merely because they may benefit from the Services.
57. SURVIVAL
Provisions relating to:
- unpaid balances;
- payment disputes;
- liability;
- damage claims;
- indemnification;
- intellectual property;
- governing law;
- dispute resolution; and
- other provisions that by their nature are intended to survive
continue after completion, cancellation, or termination of Services.
58. GOVERNING LAW
These Terms and any dispute arising from or relating to the Services are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada.
Subject to any mandatory legal right that applies, disputes shall be determined by a court or tribunal having jurisdiction in British Columbia.
59. INFORMAL DISPUTE RESOLUTION
Customers are strongly encouraged to contact New Home Moving before commencing formal proceedings.
New Home Moving may attempt to resolve concerns through:
- review of booking records;
- photographs;
- mover statements;
- invoices;
- communications;
- repair estimates;
- settlement discussions; or
- another reasonable process.
Participation in informal discussions does not constitute an admission of liability.
60. TIME FOR CLAIMS
To the fullest extent permitted by applicable law, any legal claim arising from a booking or Services must be commenced within one year after the claim arose.
Where applicable law requires a longer minimum limitation period that cannot legally be shortened by agreement, the applicable mandatory minimum period will apply instead.
This section does not extend any shorter claim-notification requirement contained elsewhere in these Terms.
61. INTERPRETATION
Headings are included for convenience and do not limit the meaning of these Terms.
Words in the singular include the plural where appropriate and vice versa.
The words "including," "includes," and similar expressions mean "including without limitation."
References to writing include electronic communications where appropriate.

BY BOOKING OR USING SERVICES ARRANGED THROUGH NEW HOME MOVING, YOU ACKNOWLEDGE THAT:
- YOU HAVE HAD AN OPPORTUNITY TO REVIEW THESE TERMS;
- THE INFORMATION YOU PROVIDED ABOUT THE MOVE IS ACCURATE TO THE BEST OF YOUR KNOWLEDGE;
- ESTIMATES MAY CHANGE BASED ON ACTUAL CONDITIONS UNLESS A GUARANTEED PRICE WAS EXPRESSLY AGREED TO;
- YOU UNDERSTAND THE APPLICABLE PRICING AND PAYMENT STRUCTURE PROVIDED WITH YOUR BOOKING;
- MOVING INVOLVES INHERENT RISKS TO PROPERTY;
- PROPERTY LIABILITY MAY BE SUBJECT TO CONTRACTUAL VALUATION AND LIMITATIONS;
- NEW HOME MOVING DOES NOT GUARANTEE THAT INSURANCE MAINTAINED BY A THIRD-PARTY SERVICE PROVIDER WILL COMPENSATE YOU FOR A LOSS;
- YOU ARE RESPONSIBLE FOR DISCLOSING HEAVY, FRAGILE, HIGH-VALUE, DANGEROUS, OR UNUSUAL ITEMS;
- YOU ARE RESPONSIBLE FOR PROVIDING SAFE AND REASONABLE ACCESS TO THE PREMISES; AND
- YOU AGREE TO BE BOUND BY THESE TERMS AND THE APPLICABLE BOOKING CONFIRMATION.
