TERMS OF USE FOR BOOKING AND MOVING SERVICES

 

The Application and website are continually under development, and New Home Moving reserves the right to revise or remove any part of these Terms of Use in its sole discretion at any time and without prior notice to you. Any changes to these Terms of Use are effective upon posting to the Site. Unless otherwise indicated, any new content added to the Site is also subject to these Terms of Use upon the posting of such content to the Site. If you at any time come to disagree with these Terms of Use, your sole remedy is to discontinue your use of the Site. Your continued use after a change has been posted constitutes your acceptance of the changes.

BY USING NEW HOME MOVING’S SERVICES IN ANY WAY, SUCH AS BY PROVIDING YOUR INFORMATION ON THE SITE, BOOKING A MOVE, AND/OR CLICKING “I AGREE” OR “BOOK NOW”, YOU ACKNOWLEDGE THAT YOU HAVE READ, ACCEPTED, AND AGREED TO BE BOUND IN WHOLE BY THESE TERMS OF USE. IF A THIRD PARTY (SUCH AS A FAMILY MEMBER, ASSISTANT, OR AUTHORIZED REPRESENTATIVE) USES THE SITE ON YOUR BEHALF, YOU AGREE THAT SUCH THIRD PARTY’S USE SHALL HAVE THE SAME LEGAL EFFECT AS YOUR OWN USE. IN OTHER WORDS, YOU AGREE THAT SUCH THIRD PARTY’S AGREEMENT TO AND ACCEPTANCE OF THESE TERMS OF USE IS BINDING UPON YOU. YOU MAY NOT USE THE SITE UNLESS AND UNTIL YOU AGREE TO THESE TERMS OF USE. IF YOU DO NOT AGREE TO BE BOUND IN FULL BY EACH AND EVERY TERM SET FORTH BELOW, DO NOT PROVIDE YOUR INFORMATION ON THE SITE, CLICK “I AGREE” OR “BOOK NOW,” OR OTHERWISE INTERACT WITH THE SITE.

I. THE NEW HOME MOVING SERVICE

NEW HOME MOVING IS A MOVING SERVICES PLATFORM THAT CONNECTS CUSTOMERS WITH INDEPENDENT CONTRACTOR MOVING PROFESSIONALS (“MOVERS” OR “OWNER-OPERATORS”). NEW HOME MOVING DOES NOT DIRECTLY EMPLOY MOVERS. RATHER, THROUGH THIS SITE AND PLATFORM, NEW HOME MOVING PROVIDES BOOKING, SCHEDULING, PAYMENT PROCESSING, CUSTOMER SERVICE, AND COORDINATION SERVICES TO FACILITATE MOVING SERVICES BETWEEN YOU (THE CUSTOMER) AND INDEPENDENT CONTRACTOR MOVERS.

The Site may at any time offer customers one or more of the following:

  • (i) information on available independent contractor movers, their availability, rates, and service areas;
  • (ii) online booking and scheduling tools for moving services including residential moves, commercial moves, furniture delivery, junk removal, and related services;
  • (iii) payment processing services for moving services, including the ability to pay by credit card, debit card, or other approved payment methods;
  • (iv) customer service and support before, during, and after your move;
  • (v) coordination and communication tools between customers and movers;
  • (vi) moving estimates, quotes, and service recommendations based on information you provide; and/or
  • (vii) additional services such as packing materials, storage coordination, and specialty item moving.
 

II. WHO MAY ACCESS THE SITE

As set forth above, you may access and/or use the Site only if you have read, accepted, and agreed in full to each and every Term that is set forth herein or may be added, revised, or otherwise amended by New Home Moving. In addition, the Site may be used only by persons who are at least eighteen (18) years of age. New Home Moving does not seek through this Site to gather personal information from or about persons under the age of 18.

New Home Moving services are available to customers located in the Lower Mainland region of British Columbia, Canada, and surrounding service areas as indicated on the Site. Service availability may vary by location and is subject to mover availability. New Home Moving reserves the right to expand or limit service areas at any time without prior notice.

 

III. SERVICE BOOKING AND ESTIMATES

When you book moving services through New Home Moving, you will receive an estimate based on the information you provide. All estimates are approximate and based on typical conditions. The actual cost of your move may differ from the estimate depending on factors including but not limited to:

  • Actual time required to complete the move
  • Additional items or services requested on moving day
  • Accessibility challenges (stairs, elevators, long carries, parking restrictions)
  • Weather conditions or other unforeseen circumstances
  • Changes to pickup or delivery locations
  • Special handling requirements for fragile or oversized items

You acknowledge that estimates are not guaranteed final prices. The final invoice will reflect the actual services provided and time spent. New Home Moving and its independent contractor movers reserve the right to adjust pricing on moving day if conditions materially differ from those described during booking.

Minimum service charges may apply. Cancellation and rescheduling policies are outlined in Section IX of these Terms of Use.

 

IV. YOUR RELATIONSHIP WITH NEW HOME MOVING

You understand and agree that New Home Moving is a platform connecting customers with independent contractor movers. The movers who perform your move are independent contractors, not employees of New Home Moving. New Home Moving does not directly provide moving services but rather facilitates the connection between customers and independent movers.

While New Home Moving screens and vets movers on its platform, maintains service standards, and provides customer service support, the moving services are ultimately performed by independent contractors. New Home Moving coordinates scheduling, payment processing, and customer communications but does not exercise day-to-day control over how individual movers perform their work.

You acknowledge that while New Home Moving strives to maintain high service standards and will assist with resolving any issues, the physical moving services are provided by independent contractors who are responsible for the safe and professional completion of your move.

 

V. PAYMENT AND PRICING

Payment for moving services must be made through New Home Moving’s approved payment methods. Acceptable payment methods include credit cards, debit cards, and other payment options as indicated on the Site. You may not pay movers directly in cash or by any other method unless expressly authorized by New Home Moving in writing for a specific transaction.

Prices for moving services are calculated based on time and materials, unless otherwise specified as a flat rate for your particular service. Hourly rates include the mover’s time, vehicle, basic equipment, and fuel. Additional charges may apply for:

  • Packing materials and supplies
  • Specialty item handling (pianos, safes, artwork, etc.)
  • Storage services
  • Long-distance or out-of-area moves
  • Additional labor or vehicles beyond the initial booking
  • Services requested on moving day that were not included in the original booking

All prices are quoted in Canadian dollars (CAD) and are subject to applicable Goods and Services Tax (GST) as required by law. GST will be calculated and added to your final invoice.

Deposits or advance payments may be required for certain bookings. Deposit requirements and refund policies will be communicated at the time of booking.

 

VI. CHARGEBACKS AND PAYMENT DISPUTES

If you dispute a charge or initiate a chargeback with your credit card company or financial institution, you agree to work with New Home Moving in good faith to resolve the dispute. Initiating a chargeback does not relieve you of your obligation to pay for services that were properly rendered.

In the event of a chargeback or payment dispute, New Home Moving reserves the right to:

  • Suspend or terminate your access to the Site and services
  • Pursue collection of amounts owed through appropriate legal channels
  • Report the dispute to credit reporting agencies if applicable
  • Recover costs associated with the chargeback including processing fees and administrative costs

If you have a concern about charges or services, we encourage you to contact New Home Moving customer service before initiating a chargeback. Many issues can be resolved through direct communication.

 

VII. CUSTOMER RESPONSIBILITIES

As a customer booking moving services through New Home Moving, you have the following responsibilities:

  • Provide accurate and complete information about your move including accurate addresses, item lists, access information, and any special requirements or challenges
  • Ensure that all items to be moved are packed and ready for moving at the scheduled time unless packing services have been specifically arranged
  • Arrange for parking for the moving vehicle(s) as close to your pickup and delivery locations as reasonably possible
  • Notify New Home Moving and the movers of any stairs, elevators, long carries, or access restrictions at pickup or delivery locations
  • Be present or arrange for an authorized representative to be present at both pickup and delivery locations
  • Ensure that pathways are clear and safe for movers to navigate
  • Remove or secure pets during the move to ensure safety
  • Provide accurate inventory of items to be moved and point out any items of exceptional value or requiring special care
  • Make payment in full according to the agreed payment terms
  • Treat movers with respect and courtesy

Failure to fulfill these responsibilities may result in delays, additional charges, or inability to complete the move as scheduled. New Home Moving and its movers reserve the right to refuse service or cancel a move if safety concerns arise or if the customer has misrepresented material facts about the move.

 

VIII. PROHIBITED ITEMS AND LIABILITY LIMITATIONS

For safety and legal reasons, New Home Moving and its independent contractor movers will not transport the following items:

  • Hazardous materials including flammables, explosives, corrosives, or toxic substances
  • Illegal drugs or contraband
  • Perishable food items that require refrigeration
  • Live plants (in some cases)
  • Pets or live animals
  • Items prohibited by law or regulation from transport

Items of extraordinary value including but not limited to currency, jewelry, important documents, family heirlooms, collectibles, artwork, and irreplaceable items should be transported by the customer personally. While our movers take care with all items, New Home Moving and its independent contractors have limited liability for items of extraordinary value.

Customers are strongly encouraged to maintain their own moving insurance or to verify coverage under their homeowner’s or renter’s insurance policy. New Home Moving and its independent contractor movers carry basic liability coverage, but this coverage is limited and may not cover the full value of your belongings. Liability limitations are set forth in Section XIII of these Terms of Use.

 

IX. CANCELLATION AND RESCHEDULING POLICY

Cancellations and rescheduling requests must be communicated to New Home Moving as soon as possible. The following policies apply:

  • Cancellations made more than 48 hours before the scheduled move time: Full refund of any deposit minus a $25 administrative fee
  • Cancellations made 24-48 hours before the scheduled move time: 50% refund of any deposit paid
  • Cancellations made less than 24 hours before the scheduled move time: No refund of deposit
  • Cancellations made after movers have departed for your location: Customer is responsible for full minimum charge plus any costs incurred

Rescheduling requests made more than 48 hours in advance will generally be accommodated without penalty, subject to mover availability. Rescheduling requests made less than 48 hours in advance may be subject to rescheduling fees.

New Home Moving and its movers reserve the right to cancel or reschedule moves due to weather emergencies, equipment failures, or other circumstances beyond our reasonable control. In such cases, customers will receive full refunds of any deposits or advance payments, but New Home Moving shall not be liable for any consequential damages resulting from such cancellation.

 

X. SERVICE STANDARDS AND CONDUCT

New Home Moving maintains service standards for all movers on its platform. Movers are expected to:

  • Arrive within the scheduled time window
  • Conduct themselves professionally and courteously
  • Take reasonable care with customer property
  • Work efficiently and diligently
  • Maintain clean and well-maintained vehicles and equipment
  • Refrain from smoking, vaping, or using cannabis on customer property
  • Refrain from use of profanity or inappropriate language
  • Not be under the influence of alcohol or impairing substances while performing services

Similarly, customers are expected to treat movers with respect and courtesy. Behavior that is threatening, harassing, discriminatory, or abusive toward movers will not be tolerated and may result in immediate termination of services without refund.

XI. DAMAGE CLAIMS AND INSURANCE

While our movers take care with all items, damage can occasionally occur during moves. If damage occurs to your property, you must:

  • Document the damage with photographs immediately
  • Report the damage to New Home Moving within 24 hours of move completion
  • Provide a detailed description of the damaged item(s) and estimated value
  • Cooperate with any investigation of the claim
  • Submit any claim in writing within 7 days of the move date

Failure to report damage within the specified timeframes may result in denial of the claim. Claims for damage discovered after 7 days will generally not be accepted unless the damage was of a nature that could not reasonably have been discovered within that timeframe.

New Home Moving’s independent contractor movers carry basic liability coverage. However, this coverage is limited. Customers are strongly encouraged to obtain their own moving insurance or verify coverage under existing homeowner’s or renter’s insurance policies for full protection of their belongings.

XII. PHOTOS, VIDEOS, AND MARKETING CONTENT

New Home Moving and its movers may take photographs or videos during moves for training, quality assurance, documentation, and marketing purposes. By booking services through New Home Moving, you grant New Home Moving a perpetual, worldwide, royalty-free license to use any photographs, videos, testimonials, or other content created during or related to your move for marketing, advertising, training, and other business purposes.

If you do not wish to be photographed or have your move documented for marketing purposes, please inform New Home Moving at the time of booking.

Customer reviews and testimonials may be published on the New Home Moving website, social media pages, and other marketing materials. By submitting a review or testimonial, you grant New Home Moving permission to use your feedback for marketing purposes.

 

XIII. LIMITATION OF LIABILITY AND DISCLAIMERS

THE NEW HOME MOVING SITE AND SERVICES ARE PROVIDED ON AN “AS IS” OR “AS AVAILABLE” BASIS. NEW HOME MOVING TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTIES’ RIGHTS, SATISFACTORY QUALITY AND FITNESS FOR PARTICULAR PURPOSE. NEW HOME MOVING MAKES NO WARRANTY THAT THE SITE IS ACCURATE, TIMELY, UNINTERRUPTED, VIRUS-FREE OR ERROR-FREE, OR THAT ANY SUCH PROBLEMS WILL BE CORRECTED.

IN NO EVENT SHALL NEW HOME MOVING BE LIABLE FOR ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, PERSONAL INJURY, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OF OR INABILITY TO USE THE SITE OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT NEW HOME MOVING WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF NEW HOME MOVING IS HELD LIABLE BY A COURT OF LAW FOR ANY DAMAGES, NEW HOME MOVING’S TOTAL LIABILITY SHALL BE LIMITED TO THE LESSER OF: (A) THE AMOUNT YOU PAID FOR THE SPECIFIC MOVING SERVICE THAT GAVE RISE TO THE CLAIM, OR (B) CAD $1,000.

Liability for damage to customer property is limited to the basic valuation coverage provided by the independent contractor movers. For residential moves, this is typically $0.60 per pound per item unless the customer has purchased additional insurance. For items of extraordinary value, customers should arrange their own insurance coverage.

New Home Moving is not liable for:

  • Damage to items improperly packed by the customer
  • Damage to items marked as fragile but not identified to the movers
  • Pre-existing damage to items
  • Damage resulting from inherent vice or defect in the items
  • Delays caused by weather, traffic, road conditions, or other circumstances beyond our control
  • Loss or damage to currency, jewelry, important documents, or other items of extraordinary value
  • Consequential or indirect damages including but not limited to lost business profits, rental costs, or hotel expenses

ANY CLAIMS ARISING IN CONNECTION WITH YOUR USE OF NEW HOME MOVING’S SERVICES MUST BE BROUGHT WITHIN ONE (1) YEAR OF THE DATE OF THE EVENT GIVING RISE TO SUCH ACTION. YOU UNDERSTAND AND AGREE THAT YOUR USE OF THE SITE AND SERVICES IS PREDICATED UPON YOUR WAIVER OF ANY RIGHT TO PARTICIPATE IN A CLASS ACTION SUIT FOR ANY LOSSES OR DAMAGES RESULTING FROM YOUR USE OF THE SITE OR SERVICES.

 

XIV. INTELLECTUAL PROPERTY RIGHTS

The Site contains text, pictures, graphics, logos, button items, images, works of authorship, and other content (collectively, “Content”). New Home Moving grants you a limited, non-exclusive, non-transferrable license to access and make personal use of the Site, but not to download (other than for page caching) or modify it, or any portion of it, except with New Home Moving’s express written consent.

The New Home Moving name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of New Home Moving or its licensors. You may not use such marks without the prior written permission of New Home Moving. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.

 

XV. PROHIBITED USES

You agree not to use the Site or New Home Moving’s services for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site. Prohibited uses include but are not limited to:

  • Attempting to gain unauthorized access to any accounts, computer systems, or networks
  • Using automated systems (bots, scrapers, etc.) to access the Site
  • Interfering with any other user’s use and enjoyment of the Site
  • Uploading viruses or malicious code
  • Attempting to reverse engineer or decompile any technology on the Site
  • Impersonating any person or entity
  • Harassing, threatening, or abusing New Home Moving staff or movers
  • Making false or fraudulent bookings
  • Using the service with intent to defraud
  • Violating any applicable laws or regulations

New Home Moving reserves the right to terminate your access to the Site and services for any violation of these prohibited uses.

 

XVI. PRIVACY POLICY

New Home Moving understands the importance of privacy and confidentiality regarding your personal information. We collect personal information including your name, address, phone number, email address, payment information, and details about your move in order to provide our services.

We use this information to:

  • Process your booking and coordinate your move
  • Communicate with you about your service
  • Process payments
  • Provide customer service and support
  • Improve our services
  • Send marketing communications (you may opt out at any time)
  • Comply with legal obligations

We do not sell your personal information to third parties. We may share your information with our independent contractor movers as necessary to perform your move, with payment processors to process transactions, and with service providers who assist us in operating our business. We may also disclose information when required by law or to protect our rights.

XVII. INDEPENDENCE OF MOVERS

Movers featured on and providing services through the New Home Moving platform are independent contractors, not employees of New Home Moving. These independent contractors operate their own businesses and are responsible for their own business expenses, taxes, insurance, and regulatory compliance.

New Home Moving facilitates connections between customers and movers, provides a booking and payment platform, maintains service standards, and offers customer service support. However, the actual moving services are provided by independent contractors who have contractual relationships with New Home Moving but are not under its day-to-day control.

Any opinions, representations, or actions of individual movers do not reflect the opinions of New Home Moving and are the responsibility of the individual mover. While New Home Moving screens and vets movers on its platform and may remove movers who fail to meet service standards, New Home Moving does not endorse or guarantee any specific mover.

New Home Moving’s revenue comes from service fees charged to customers for use of the platform, payment processing, customer service, and coordination services. These fees are disclosed during the booking process.

 

XVIII. THIRD PARTY LINKS AND SERVICES

The Site may contain links to third-party websites, services, or resources. These links are provided for your convenience only. New Home Moving has no control over the content, products, services, or privacy practices of third-party sites.

New Home Moving is not responsible for and does not endorse any third-party sites or the content, products, or services offered through them. If you access third-party sites through links on the New Home Moving site, you do so at your own risk. We encourage you to review the terms of use and privacy policies of any third-party sites you visit.

 

XIX. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless New Home Moving, its affiliates, contractors, independent contractor movers, and its directors, officers, employees, representatives, agents, and attorneys from and against any and all suits, actions, claims, proceedings, damages, settlements, judgments, injuries, liabilities, obligations, losses, risks, costs, and expenses (including, without limitation, attorneys’ fees and litigation expenses) relating to or arising from:

  • Your use of the Site or services
  • Your violation of these Terms of Use
  • Your violation of any law or regulation
  • Your violation of any rights of another person or entity
  • Your provision of false or misleading information
  • Your conduct toward movers or New Home Moving staff
  • Any items you provide for moving that are illegal, prohibited, or hazardous
 

XX. TERMINATION

New Home Moving may terminate or suspend your access to the Site and services at any time, with or without cause, and with or without notice, for any reason including but not limited to:

  • Violation of these Terms of Use
  • Fraudulent or illegal activity
  • Abusive, threatening, or harassing behavior toward movers or staff
  • Making false or fraudulent bookings
  • Initiating unwarranted chargebacks or payment disputes
  • Failure to pay for services rendered
  • Any conduct that damages or could damage New Home Moving’s reputation or business

Upon termination, your right to use the Site and services immediately ceases. You remain liable for any amounts owed for services rendered prior to termination. Provisions of these Terms of Use that by their nature should survive termination (including but not limited to indemnification, limitation of liability, and dispute resolution provisions) shall survive termination.

 

XXI. DISPUTE RESOLUTION AND GOVERNING LAW

These Terms of Use and any disputes arising from them or from your use of New Home Moving’s services shall be governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflicts of law principles.

Any disputes between you and New Home Moving shall be resolved in the courts of British Columbia, and both parties consent to the exclusive jurisdiction and venue of such courts.

A. TIME TO PRESENT CLAIMS

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Site or services or to this Agreement must be filed within one (1) year after such claim or cause of action accrued or shall be forever barred.

B. INFORMAL DISPUTE RESOLUTION

Prior to initiating any legal action, you agree to first contact New Home Moving to attempt to resolve the dispute informally. Many disputes can be resolved through good faith communication. Please contact customer service at the contact information provided on our website. New Home Moving will make reasonable efforts to resolve disputes amicably within 30 days.

C. NO CLASS ACTIONS

YOU ACKNOWLEDGE AND AGREE THAT YOU AND NEW HOME MOVING ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING. ALL CLAIMS MUST BE BROUGHT IN THE PARTIES’ INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING.

 

XXII. GENERAL PROVISIONS

A. ENTIRE AGREEMENT

These Terms of Use constitute the entire agreement between New Home Moving and you regarding your use of the Site and services and supersede all prior agreements and understandings, whether written or oral, regarding such subject matter.

B. AMENDMENTS

New Home Moving reserves the right to modify these Terms of Use at any time. Changes will be effective upon posting to the Site. Your continued use of the Site or services after changes are posted constitutes acceptance of the modified Terms of Use. We encourage you to review these Terms periodically.

C. SEVERABILITY

If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent as closely as possible.

D. WAIVER

No waiver of any provision of these Terms of Use shall be deemed a further or continuing waiver of such provision or any other provision. New Home Moving’s failure to assert any right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

E. ASSIGNMENT

You may not assign or transfer these Terms of Use or any rights or obligations hereunder without New Home Moving’s prior written consent. New Home Moving may assign or transfer these Terms of Use or any rights or obligations hereunder at any time without restriction.

F. NO AGENCY RELATIONSHIP

Neither these Terms of Use nor any use of the Site or services creates any partnership, joint venture, employment, or other agency relationship between you and New Home Moving. You may not enter into any contract on our behalf or bind us in any way.

G. ELECTRONIC COMMUNICATIONS

When you visit the Site or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the Site. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

H. LANGUAGE

These Terms of Use are written in English. If these Terms are translated into any other language, the English version shall prevail to the extent of any inconsistency.
